Bleibt der Innovationsschutz auf der Strecke oder ist KI ein Katalysator für schützbare Innovationen?
Die möglichen Auswirkungen von künstlicher Intelligenz (KI) auf Patent-, Design- und Urheberrechtsschutz lassen sich aktuell nur erahnen. Diese reichen von einer deutlichen Beschleunigung jeglicher Innovationen bis zur Erkenntnis des Zauberlehrlings aus 1797 aus Johann Wolfgang von Goethes Ballade „Die ich rief, die Geister werd ich nun nicht los.“ Dabei sind Gesellschaft und Gesetzgeber aufgerufen, die unerwünschten Eigenschaften der KI zu ihren „Zwecken“ zu regulieren, weiterzuentwickeln und aufeinander abzustimmen. Herausfordernd wird die Geschwindigkeit der Veränderungen durch KI auf den Innovationsschutz sowie die Komplexität der Anwendungsfälle und – ob die Anpassung der gesetzlichen Rahmenbedingungen Schritt halten kann.

Intellectual Property (IP) Strategy in Mechanochemistry

Sustainable manufacturing is one of the most common demands the industry, such as the pharmaceutical, chemical, and biotechnological industry, is faced with today. The most straightforward sustainable manufacturing such as grinding with mortar and pestle – a mechanochemical treating method – goes back to the stone age. Since then, in the last century, several mechanochemical methods and apparatuses, such as specific ball mills, were designed to increase the energy input into the grinding process, to initiate chemical reactions besides particle size reduction. Many of these innovations were protected by patents and exploited by industry.
The following chapter will give a short view into the history of innovations in sustainable manufacturing methods and of apparatuses in patent databases, present own know-how from the authoress Ph.D. work which was not allowed to be mentioned in the thesis, an overview of intellectual property rights and their requirements as well as proposals for a mixed synergistic innovation process. For a better understanding, the definitions of mechanochemistry and sustainable manufacturing will be given below.

In the last few years, any circumstances taken for granted were wiggled or even turned upside down. We had to learn that in a globally connected world, the sun does not rise more beautifully every day. We learned that the supply chains were disrupted. Many comfortable conditions we could have enjoyed during the last decades, and we conceived as being on solid ground, have been turned upside down. Thus, Europe needs to become more resilient. On issues of healthcare and our core industries, on which Europe’s prosperity rests. We need to be more adaptable to influences on the European economy, where we do not have a direct impact.

Unified patent system for Europe

Better protection for innovations through a more uniform and cost-effective patent system
After almost 50 years of development, the Unitary Patent and the Unified Patent Court will be launched in the European Union in 2022. Innovation protection of inventions will thus be possible in future in a more uniform and cost-effective manner. However, the new regulations are associated with risks for companies also.

Einheitliches Patentsystem für Europa

Nach nunmehr fast 50 Jahren Entwicklungsprozess geht im Jahr 2022 in der Europäischen Union das Einheitspatent und das einheitliche Patentgericht an den Start. Zukünftiger Innovationsschutz von Erfindungen wird somit einheitlicher und kostengünstiger möglich sein. Die neuen Regelungen sind für Unternehmen aber auch mit Risiken verbunden.
